Terms & Conditions – 2021 Business Support Scheme (the “Promotion”)
- 1. Eligibility

- 1.1. This Promotion is run by Sky Subscribers Services Limited (“Promoter”) and is open to Republic of Ireland based businesses who: (i) have been trading for 12 months or more; and (ii) are new to TV advertisement or not advertised on TV within the 12 months preceding 19 July 2021. Employees (or members of their immediate families, including any live-in partner or household member) of the Promoter, companies associated with the Promotion and all affiliates of such companies may not enter this Promotion.

- 1.2. The rules set out in this document constitute the rules which will govern the Promotion (“Promotion Rules”).

- 2. Entry Period
This Promotion will run from 00:01 on Monday 19 July 2021 until 16:59 on Tuesday 3 August 2021 or until the Promoter provides a public notice that the Promotion has ended, whichever is earlier (“Promotional Period”). Entries will only be accepted during the Promotional Period.

- 3. Entry Requirements

- 3.1 In order to enter this Promotion, entrants (“Participants”) must submit to the Promoter the Participant business details (or those details of the business that is being nominated) either online (www.adsmartfromsky.ie) or via email (adsmartfromsky@sky.ie) during the Promotional Period.

- 3.2 A Participant may only enter this Promotion once. Where a business receives multiple nominations and/or nominates itself, the business’ own nomination or (if none) the first nomination will be used for entry to this Promotion.

- 4. Winner Selection and notification

- 4.1 Winners will be selected by an internal panel of the Promoter (including an independent judge) that the panel feels will benefit and succeed the most through the introduction of TV advertising into their marketing strategy.

- 4.2 The winners will be selected on or around Friday 6 August 2021 from all valid entries received during the Promotional Period. The winners will be notified by the Promoter via email on or around Wednesday 11 August 2021.

- 4.3 If a winner cannot be contacted within a reasonable time period, or are not able or available to accept the Prize for any reason which is beyond the Promoter’s reasonable control, the winner will be disqualified. The Promoter reserves the right to award the Prize to a substitute winner using the same winner selection process.

- 4.4 The Prize will only be awarded after successful verification of the winner. Failing successful verification of any winner, a substitute winner may be selected at the discretion of the Promoter.

- 4.5 The Promoter reserves the right to carry out audits in respect of any winner to verify their eligibility and/or the validity of the nominating entry. The Promoter may disqualify any winner if any fraud, cheating or related activity is suspected, including without limitation, through the manipulation of entry or otherwise falsifying data.

- 5. Prizes

- 5.1 The prize for this Promotion per winner is a TV advertising campaign to the value of EURO 20,000 (excluding VAT) that uses bespoke geo or demographic targeting across the Promoters AdSmart enabled channels subject to the following:

- 5.1.1 the TV advertisement campaign will be for a maximum of 6 weeks in duration and will be during 2021;

- 5.1.2 the maximum length of the TV advertisement used in the campaign shall be 30 seconds;
-

- 5.1.3 the winner must create and fund a Clearcast approved 30 second TV advertisement and shall provide the approved advertisement to the Promoter; and
-

- 5.1.4 the TV advertisement campaign shall be subject to any Sky Media AdSmart Terms and Conditions in place at the time of the campaign (available at https://www.skymedia.ie/terms-and-conditions-ireland-2/ ),
(the “Prize”)

- 5.2 The Prize does not include any other service or item not specifically described above.

- 5.3 If a winner has any issues in relation to the Prize or special accessibility requirements, the winner may contact the Promoter at adsmartfromsky@sky.ie. The Promoter endeavours, but does not guarantee, to accommodate a winner’s requests.

- 6. Data Protection

- 6.1 Each Participant and each winner, by participating in this Promotion or receiving a Prize, acknowledges, agrees and expressly consents to the following:

- 6.1.1 the use of any entrant data collected for the purpose of administering this Promotion and contacting the winners to notify them of and deliver the Prize; and

- 6.1.2 the use of a winner’s surname, county and winning entry for post-event publicity purposes without additional remuneration. Winners can object to this publication or ask for less information to be published or made available by contacting the Promoter through the “Contact us” link on the Sky Connect website. If a winner objects, the Promoter may still be required to provide information to the Advertising Standards Authority. The Promoters Privacy Notice is available at skyconnect.uk, which processing and transfer shall take place in accordance with the provisions of EU General Data Protection Regulation 2016/679 and any other applicable or equivalent data protection or privacy legislation, regulations or guidance from time to time relating to the processing of personal data, and for the purpose of giving effect to this Promotion.

- 7. General

- 7.1 This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter and/or LinkedIn. Facebook Twitter and/or LinkedIn are in no way responsible for any aspect of this Promotion.

- 7.2 The Promoter does not accept any responsibility for network, computer, hardware or software failures of any kind, which may restrict or delay the sending or receipt of a Participants entry. Proof of entry submission is not proof of receipt.

- 7.3 Winners agree to sharing post campaign transmission response data with the Promoter for an effectiveness study to be conducted and allowing the Promoter to contact them to discuss market research or other publicity opportunities. The results of the effectiveness study may be used as a case study by the Promoter and published publicly. A data sharing agreement and/or release agreement between the Promoter and the winner will be put in place before the campaign evaluation.

- 7.4 There is no cash alternative to the Prize or credit and unless agreed otherwise in writing the Prize is non-refundable and non-transferable.

- 7.5 The Promoter reserves the right to substitute the Prize for a prize of equivalent or greater monetary value if this is necessary for reasons beyond its control.

- 7.6 Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from: the enjoyment of the Prize; any postponement, cancellation, delay or changes to the Prize beyond the Promoter’s control; and/or for any act or default of any third party supplier.

- 7.7 The Promoter will not be liable for any Prize(s) that do not reach the winners for reasons beyond the Promoter’s reasonable control.

- 7.8 All Participants and the winner indemnify and hold harmless the Promoter, their respective associated companies (directors, officers and employees) and agents, against any and all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever connected to or arising out of their participation in any way in this Promotion or their receipt, participation, ownership and/or use of the Prize.

- 7.9 No nominated business may win more than one Prize in this Promotion.

- 7.10 The Promoter’s decision is final and binding in all respects on all Participants. No correspondence will be entered into. Entries that do not completely comply with these entry terms and conditions will be disqualified.

- 7.11 These Promotion Rules may be amended by the Promoter on public notice at any time during the Promotional Period or thereafter. These Promotion Rules will be interpreted by the Promoter only.

- 7.12 The Promoter may refuse or disqualify any entry (including winning entries) if there are reasonable grounds to believe there has been a breach of these Promotional Rules or if the Participant concerned or anyone authorised by the Participant to deal with their entry, acts in a way towards the Promoter, other Participants or the Promoters staff which the Promoter reasonably considers to be inappropriate, unlawful or offensive. If the winning entry is disqualified the Promoter reserves the right to award the Prize to another nominated business.

- 7.13 The Promoter reserves the right to alter, amend or cancel this Promotion in whole or in part. Any alterations, amendments or cancelations will be interpreted by the Promoter only. In the event of an alteration, amendment and/or cancellation the Promoter will not compensate any individual or business for any reason whatsoever.

- 7.14 Participants and winners will be deemed to have accepted these Promotion Rules and agreed to be bound by them when entering this Promotion or accepting the Prize.

- 7.15 This Promotion, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. Participants and winners irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Promotion.
